developed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “GDPR”) and Act no. 18/2018 Coll. on the protection of personal data (hereinafter referred to as the “Personal Data Protection Act”)

Rebecca Group, s.r.o. , with  its registered office at Révová 7,  811 02, Company ID: 55 525 300, registered in the Commercial Register of the District Court Bratislava I, Section: Sro, File No.: 170580/B (hereinafter referred to as “REBECCA GROUP”  or “our company”) respects the privacy of all data subjects with whom it is in contact; regardless of whether it processes personal data itself or through third parties. It is extremely important for our company that each data subject understands which personal data we process for them, why we do it and what their rights are. We may process the personal data of data subjects in different ways and in different situations depending on the type of data subject. In this document below you will find general information such as:

  • identification and contact details of our company (Section 1 of this document),
  • Your rights in relation to the processing of your personal data (Section 2 of this document),
  • information on automated individual decision-making, including profiling (Section 3 of this document);

For more information on the processing of personal data in your specific case, please refer to Article 4. of this document, depending on whether you are:

  • visitor to our website (section 4.1. of this document)
  • the client or the person interested in the product, (section 4.2. of this document)
  • job seeker, (section 4.3 of this document)
  • supplier (or business partner) (section 4.4 of this document)

We would also like to ask you, on behalf of the REBECCA GROUP, to  always provide us with up-to-date and correct personal data, which will subsequently be processed by our company. If there is a change in personal data, we also ask you to notify you of this fact without undue delay. To protect your personal data from unauthorized persons and against unlawful processing, unforeseen loss, destruction and damage, both online and offline, we use physical, electronic and organizational measures to prevent such situations from occurring in accordance with our internal privacy policy.

REBECCA GROUP does not have a data protection  officer appointed (our company is not obliged to appoint a data protection officer in accordance with the GDPR and the Personal Data Protection Act).

 

2. Rights of the data subject

If our company processes your personal data, you, as the data subject, have the following rights:

  • Revoke consent – in cases where we process your personal data based on your consent, you have the right to withdraw this consent at any time. You may withdraw your consent electronically, at the address given in section 1 of this document, in writing, by notice of withdrawal of consent (or other appropriate means). The withdrawal of consent does not affect the lawfulness of the processing of personal data that we have processed about you on its basis.
  • Right of access – you have the right to be provided with a copy of the personal data we have about you, as well as information about how we use your personal data. In most cases, your personal data will be provided to you electronically, if technically feasible.
  • Right to rectification – we take reasonable measures to ensure the accuracy, completeness and timeliness of the information we have about you. If you believe that the data we hold is inaccurate, incomplete or out of date, please do not hesitate to ask us to modify, update or supplement this information.
  • Right to erasure (to be forgotten) – you have the right to ask us to erase your personal data, for example if the personal data we have collected about you are no longer necessary to fulfill the original purpose of processing. However, your right must be assessed in the light of all relevant circumstances. For example, we may have certain legal obligations, which means that we will not be able to comply with your request.
  • Right to restriction of processing – under certain circumstances, you are entitled to ask us to stop using your personal data. This is the case, for example, if you think that the personal data we have about you may be inaccurate or if you think that we no longer need to use your personal data.
  • Right to data portability – under certain circumstances, you have the right to ask us to transfer the personal data you have provided to us to another third party of your choice. However, the right to portability applies only to personal data that we have obtained from you on the basis of consent or under a contract to which you are one of the parties.
  • Right to object – you have the right to object to data processing that is based on our legitimate interests. If we do not have a convincing legitimate reason for processing and you object, we will no longer process your personal data.
  • The right to file a motion to initiate proceedings on personal data protection – if you believe that your personal data are processed unfairly or illegally, you may file a complaint with the supervisory authority, which is the Office for Personal Data Protection of the Slovak Republic, Hraničná 12, 820 07 Bratislava 27; tel. number: +421 /2/ 3231 3214; mail: statny.dozor@pdp.gov.sk, https://dataprotection.gov.sk. If the application is submitted electronically, it is necessary that it meets the requirements under Section 19(1) of Act No. 71/1967 Coll. on Administrative Proceedings (Code of Administrative Procedure).

3. Automated decision-making and profiling

Your personal data will not be used for automated individual decision-making, including profiling.

 

4. Information on the processing of personal data by data subjects

The provisions of this point 4. do not apply to data subjects who have been specifically instructed in writing by the REBECCA GROUP in  accordance with Sections 19 and 20 of the Personal Data Protection Act if the data subject has signed such instruction in his/her own hand, from the moment of such handwritten signing of the instruction.

 

4.1. Visitor to the REBECCA GROUP website

The REBECCA GROUP is the operator of the website located at www. Rebeccahomes. SK and www.rebeccarealestate.sk (hereinafter referred to as the “Website”).

What are cookies?
If you visit a site (including our company’s website) that records cookies, a small text cookie is created on your computer. 4.1.1. Purpose of personal data processing

The REBECCA GROUP may process your data for the following purposes:

  • optimization of website display and targeting of advertising using cookies,
  • sending marketing materials and offers at the request of the data subject (so-called “mailing”) or after expressing your consent to the processing of personal data for such purpose.note: in the case of sending your contact details for the purpose of contact by our company due to interest in our company’s services, section 4.2 of this document entitled “Client or Product Seeker” applies to you instead of this section 4.1.
4.1.2. Legal basis

If our company is able to identify the person of the website visitor during recording, this will be the processing of personal data. We must have a legal basis for such processing.

  • One legal basis for monitoring activities and evaluating them is the legitimate interest of the operator, i.e. our company, to offer you the best specific settings of services or support for your activities on the website, including direct advertising, and
  • the second legal basis may be the consent of you as the data subject, while in connection with consent, as the legal basis for the processing of personal data, our company declares that it follows from the nature of the products provided by our company that they are not intended or directed for children under 16 years of age, and therefore our company is not obliged to verify whether a legal representative has given consent to the processing of his or her personal data to a person under 16 years of age (pursuant to § 15 of the Personal Protection Act data).
4.1.3. Scope of personal data processing

Our company REBECCA GROUP processes “ordinary personal data” to the extent necessary to fulfill the purposes stated in point 4.1.1. of this document, in particular to the following extent:

If our company can identify the person of the website visitor during recording, the following types of cookies as well:

  • Strictly necessary cookies: Strictly necessary cookies guarantee functions without which you would not be able to use the website and ensure, among other things, that when you call up website functions, a version is displayed that has a volume of data corresponding to the broadband internet connection you are using. In addition, cookies of this type store your decision about the use of cookies on our site. The strictly necessary cookies we use are, in particular:- cookies that are used exclusively to ensure the transmission of data over the Internet; a- cookies that are strictly necessary to provide you with a service that you have explicitly requested (i.e. if these cookies are disabled, we will not be able to provide you with the service you have explicitly requested).
  • Analytics/performance cookies: These cookies are used to provide statistical information about the performance of our website (e.g. number of visits, traffic sources, etc.).
  • Functional cookies: These cookies allow our website to remember choices made on your device while browsing the website and to provide enhanced and personalized features. This category may include third-party cookies.
4.1.4. Categories of beneficiaries

Personal data is processed directly by our company, in electronic form. Certain activities for our company are carried out by subcontractors. For the purpose of performing these activities, it is required that your personal data be provided to such a subcontractor to the extent necessary for the performance of the subcontractor’s tasks. Such external subcontractors are, in particular, external companies providing IT services to our company, companies operating web hosting and management of servers and/or data storage, or other consulting companies. Specific companies and activities are subject to change according to the current needs of
the REBECCA GROUP. Personal data may also be made available to entities authorized under special regulations (e.g. law enforcement agencies, etc.).

4.1.5. Transfer of personal data

Our company may also process some personal data (e.g. name, surname and e-mail) through service providers, electronic systems and data storage systems operated by persons (processors) outside the European Union. Our company always verifies that they ensure the highest possible protection of personal data in accordance with the relevant legal regulations (i.e. they are part of the European Commission’s adequacy decision, e.g. part of the EU-US Privacy Shield program, if located in the USA, etc.).

4.1.6. Duration of personal data processing

Browsing data stored according to cookie settings is not stored in our systems. We store the information we associate with cookie data according to your consent given to us or according to the duration of the contractual relationship between us and you. We will store the combined data from cookies and our systems for the time necessary for the purpose for which they were collected, but no longer than 2 years. Personal data obtained for the purpose of sending marketing materials and offers at the request of the data subject and after expressing the consent of the data subject will be processed for a period of 5 years or until the moment of withdrawal of the consent of the data subject (see the first indent of point 2 of this document).

 

4.2. Client (or interested in the product)

REBECCA GROUP product  means any service provided by  the REBECCA GROUP  and/or any goods sold by  the  REBECCA GROUP.

4.2.1. Purpose of personal data processing

In order to conclude and perform a contract with you or the company you represent or to be able to use the product we offer, it is necessary to process your personal data. We may also process personal data about visitors to our websites or physical locations, depending on how you have chosen to interact with us in connection with interest in our company’s product(s). The purpose in specific cases is in particular the processing of personal data in connection with the following activities: (i) the conclusion of a contract, in particular an intermediary contract, a purchase contract, a lease agreement or other contracts and the processing of related documents (protocols, deposit proposals, powers of attorney), their registration or control and modifications, including ensuring the performance of these contracts; (ii) advertising of real estate on real estate portals, whereby advertising (or registration of real estate within databases of real estate portals) may in some cases contain personal data of the property owner (in this case, however, your consent is required for such processing); (iii) processing records of property inspections; (iv) the bookkeeping of the company. Source of personal data. Contact personal data is provided to our company by the person interested in the product himself, voluntarily, or our company obtains them from publicly accessible sources (registers and databases of those interested in products similar to our company’s products) or from cooperating persons (if such handling of personal data is in accordance with the law, while the confidentiality of personal data is always ensured by the contract).

4.2.2. Legal basis

We only process your personal data if we have a legal basis to do so.

  • This means that the processing must be necessary for the performance of a contract to which you or the company you represent are a party or so that, on request, pre-contractual steps can be taken (the legal basis is therefore the contract, including pre-contractual relations, and the fulfilment of individual rights and obligations under such a contract and related documents).
  • In accordance with our legitimate interest, we may also use your data for the proper conduct of our company’s business activities to provide you with information about our products, prospects, analyses that could be in your best interest or to be able to perform necessary or required tasks arising from the business relationship (the legal basis is therefore the legitimate interest of our company).
  • We are legally obliged to provide your personal data for inspection by authorised institutions and for the prevention, monitoring and proof of fraud and other crimes (the legal basis is therefore also the law in selected cases).
4.2.3. Scope of personal data processing

The REBECCA GROUP processes “ordinary personal data” to the extent necessary to fulfil the purposes stated in point 4.2.1 of this document, in particular to the following extent:

  • name, surname, title
  • permanent residence address, correspondence address
  • date of birth (if necessary for the purpose of unambiguous and unmistakable identification of the client, especially in the case of a written contract)
  • maiden name, nationality, birth number, ownership of real estate (if the client is in connection with the purchase or sale of real estate; these are mandatory data contained in the purchase contract for real estate)
  • IČO, VAT ID, VAT ID, place of business, registered office or operation (which may be the same as residence); in the case of clients – self-employed
  • phone number, e-mail
  • account numbers (for sending possible contractual performances)
  • signature
4.2.4. Categories of beneficiaries

Personal data is processed directly by our company, in written and electronic form. Personal data may be made available to entities authorized under special regulations, which are, in particular: law enforcement agencies, courts, bailiff’s offices, etc. Certain activities for our company are carried out by subcontractors. For the purpose of performing these activities, it is required that your personal data be provided to such a subcontractor to the extent necessary for the performance of the subcontractor’s tasks. Such external subcontractors are, in particular, external accounting, tax, legal and other consulting companies, companies operating web hosting and management of servers and/or data storages, real estate agencies, development companies, real estate sellers/buyers, etc. Specific companies and activities are subject to change according to the current needs of the
REBECCA GROUP.

4.2.5. Transfer of personal data

Our company may also process some personal data (e.g. name, surname and e-mail) through electronic systems and data repositories operated by persons (processors) outside the European Union. Our company always verifies that they ensure the highest possible protection of personal data in accordance with the relevant legal regulations (i.e. they are part of the European Commission’s adequacy decision, e.g. part of the EU-US Privacy Shield program, if located in the USA, etc.).

4.2.6. Duration of personal data processing

Your data is stored by our company for as long as it is necessary to fulfill the purpose of processing according to special regulations and the purpose for which it was collected (see point 4.2.1 above), if we have a legitimate interest in storing it, e.g. until the termination of the contractual relationship. After termination of the contractual relationship and settlement of all obligations arising from or related to such contractual relationship, our company retains your personal data for the necessary time, for the period required by applicable law. If such a period is not stipulated by law, our company is entitled to store your personal data for at least three years from the date of termination of the contractual relationship (but not more than ten years, unless the applicable legislation provides for a higher retention period). In the event of a lawsuit with you (as the data subject), at least three years from the date of the final termination of the litigation.

 

4.3. Jobseeker

 

4.3.1. Purpose of personal data processing

The REBECCA GROUP will process your data for the following purposes:

  • Recruitment of new employees. We process your data to determine whether you are a qualified candidate for the position for which you are applying.
  • Dispute resolution. Personal data may be processed by our company for the purpose of resolving disputes, complaints or legal proceedings.
  • Compliance with the law. We may need to process your personal data in order to comply with the law or to comply with a court decision. Source of personal data. Personal data is provided to our company by the job seeker himself, voluntarily or our company obtains them from publicly accessible sources (registers and databases of job seekers).
4.3.2. Legal basis

Our company processes your personal data because the processing is necessary for the purposes of our company’s legitimate interest. Our legitimate interest in this case is to recruit qualified candidates. In some cases, we will process your personal data in order to comply with legal obligations (i.e. on a legal basis) or we will process it on the legal basis of pre-contractual relationships (whereby, in the case of concluding an employment contract, you, as an employee of our company, will be separately instructed in writing in relation to the protection of personal data).

4.3.3. Scope of personal data processing

If you are interested in a job in our company, we obtain the following information from you:

  • Contact details: such as your name, surname, title, permanent address, temporary residence address, private email address, telephone number.
  • Information from your CV/CV: such as your previous jobs, education, skills, language skills and any other information you choose to include in your CV.
  • Cover letter.: any information you choose to include in your cover letter.
  • Fitness for work: you may need to prove that you are legally fit to work with us, e.g. education, language skills, medical fitness for selected types of positions, etc.
  • References: we may choose to obtain references from people who have worked with you in the past. Generally speaking, we will only contact these individuals if you provide us with their names and contact details.
4.3.4. Categories of beneficiaries

Personal data is processed directly by our company, in written and electronic form. Our company may share your data with third parties in the following circumstances:

  • If we obtain information from third parties (as described above), we will provide them with your first and last name and any other information necessary to provide us with relevant information about you.
  • If required by law or court order, we may share your personal data, for example, with law enforcement authorities or other authorized authorities of the Slovak Republic.
  • We may also provide your personal data to companies with economic or personal connections to our company if there is a legitimate interest of our company.

Certain activities for our company are carried out by subcontractors. For the purpose of carrying out these activities, it is required that such subcontractor be provided with the personal data of the data subject to the extent necessary for the performance of the subcontractor’s tasks. Such external subcontractors are, in particular, external recruitment agencies, accounting, tax and other consulting companies, companies operating data storage and server management. Specific companies and activities may be subject to change according to the current needs of our company.

4.3.5. Transfer of personal data

Our company may also process some personal data (e.g. name, surname and e-mail) through electronic systems and data repositories operated by persons (processors) outside the European Union. Our company always verifies that they ensure the highest possible protection of personal data in accordance with the relevant legal regulations (i.e. they are part of the European Commission’s adequacy decision, e.g. part of the EU-US Privacy Shield program, if located in the USA, etc.).

4.3.6. Duration of personal data processing

We keep your personal data for a limited period of time and this data will be deleted as soon as it is no longer needed for processing purposes. This means that we will keep your data for the duration of the selection procedure and always delete it on the last day of the year following the year in which we became acquainted with your personal data. The reason for this retention is to protect our interests in the event of dispute resolution. If we select you to fill the position, we will store your personal data in the personal file, in accordance with our internal basic principles of personal data processing (in the form of a directive). We may process your personal data for a longer period of time after the end of the selection process, in the event of a legal dispute or if you give us permission to keep your personal data on file for a longer period.

 

4.4. Supplier (or business partner)

 

4.4.1. Purpose of personal data processing

The purpose of the processing of personal data is (i) a selection procedure for the position of a supplier of services and/or goods to our company REBECCA GROUP  or a cooperating person  of the REBECCA GROUP, regardless of whether it is a long-term supplier-customer relationship or a one-time delivery (hereinafter referred to as the “supplier”) and the subsequent registration of suppliers and the administration of the pre-contractual/contractual relationship between the supplier and our company,  (ii) conducting our company’s business, (iii) keeping the company’s accounts, as well as (iv) protecting our company’s property, and (v) any other purposes for which the supplier has given his consent. Source of personal data. Personal data is provided to our company voluntarily by the supplier himself or our company obtains them from publicly accessible sources (registers and databases).

4.4.2. Legal basis

The legal basis for the processing of personal data is:

  • exercising rights and fulfilling contractual obligations arising in particular from the contract between REBECCA GROUP and the supplier and related documentation, including pre-contractual relations (regardless of whether such contract is concluded orally or in writing, including in the form of an order); and
  • In certain cases, also the legitimate interest of our company in the proper performance of its business activities.
  • We are legally obliged to provide your personal data for inspection by authorised institutions and for the prevention, monitoring and proof of fraud and other crimes (the legal basis is therefore also the law in selected cases).
4.4.3. Scope of personal data processing
